The plain-language rules for using GalaxyOrb.cloud. Please read them before you order: they explain how billing, renewals, cancellation and refunds work.
1. This agreement
These Terms of Service (the "Terms", also called our Service Agreement) are a contract between you and GalaxyOrb LLC ("GalaxyOrb", "we", "us"). They cover our website, the client area and every service you order from us: web hosting, cloud servers (vOrb) and game servers.
You accept these Terms when you place an order. Our Privacy Policy and the Acceptable Use Policy in section 9 are part of them. If you use our services for a business, you confirm you may accept these Terms for it.
2. Your account
You must be at least 18 years old and able to enter a binding contract to open an account.
- Give us accurate contact and billing details, and keep them up to date.
- You sign in with a passkey. Keep your devices secure. Anything done through your account counts as done by you.
- Tell us at once at support@galaxyorb.cloud if you think someone else has accessed your account.
3. Orders and services
Each order lists what you get: the plan, its resources and options, and the price. A service starts once its first invoice is paid. Most services are set up automatically; we may review an order before setup and cancel it with a full refund if we believe it is fraudulent or breaks these Terms.
You have full control of, and responsibility for, what runs on your service: software, updates, security settings and the content you or your users put there. Cloud servers come unmanaged. Our support helps with the platform, not with your own software.
4. Billing and automatic renewal
Prices are in US dollars. Services are billed in advance for the period you chose (for example, monthly) and renew automatically until you cancel.
- We create the renewal invoice 14 days before the due date. You can see it, and pay it, in your client area.
- If you saved a card, we charge it on the due date. If the charge fails, we retry once a day, three attempts in all.
- If a renewal is still unpaid 3 days after its due date, the service is suspended. Paying the invoice restores it.
- A service that stays suspended for non-payment may be terminated, and its data deleted.
- The price of a service you already have stays the same at renewal unless we tell you about a change at least 30 days before it applies. Plan prices for new orders can change at any time.
- Prices don't include taxes. If we have to collect a tax, it will be shown before you pay.
Card payments are processed by Stripe. We never see or store your full card number. If you think a charge is wrong, please contact us first: we will look into it quickly. Disputing a charge with your bank while the service is in use may lead to the account being suspended until the dispute is settled.
5. Cancellation and refunds
You can cancel any service from your client area at any time, in one of two ways:
- At the end of the period. The service keeps running until its paid time ends, then it is removed. Nothing more is charged. You can change your mind until then.
- Immediately. The service and all of its data are deleted at once. The unused part of the period you paid for is returned to you, as you choose, either as account credit or as a refund to the card you paid with.
There is no money-back period beyond that: you pay only for the time you used. Unused time is worked out by the day, from the prices you paid for the service and its add-ons. Setup fees, and time already used, are not refunded. Removing an add-on returns its unused time as account credit.
A refund can only go back to a card that paid for the service, up to the amount paid, and only for card payments made in the last 180 days. Any part that can't go back to a card is added as account credit. Card refunds usually take 5 to 10 business days to appear.
Services terminated because of a breach of these Terms, including the Acceptable Use Policy, don't receive a refund or credit for unused time.
6. Account credit
Account credit is held in your account's currency and is used to pay your invoices. It doesn't earn interest and can't be transferred to another account.
Credit that came from card payments (for example, unused time from a cancellation) can be cashed out from the Billing page. It is refunded to the card that paid it, less a 5% fee, and only within the 180-day limit above. Credit given by us, for example as a goodwill gesture or a promotion, can only be spent on our services.
7. Your data and backups
You own the content on your services. We access it only to provide and support the service, to keep the platform secure, or when the law requires it.
You are responsible for keeping your own backups. Snapshots and automatic backups, when included or bought as add-ons, are a convenience and are stored on the same platform. They are not a guarantee against loss. When a service ends, its data, snapshots and backups are permanently deleted and can't be recovered.
8. Availability and changes
We work to keep services running and fix problems quickly, but we don't guarantee uninterrupted or error-free service. We don't currently offer an uptime guarantee (SLA). We may carry out maintenance, and we try to announce planned work in advance when it affects your service.
We may change or retire a plan or feature. If we retire a service you pay for, we will give you reasonable notice and return any unused time as credit.
9. Acceptable Use Policy
You must use our services lawfully and in a way that doesn't harm others or our platform. You may not use them, or let anyone else use them, to:
- Break any law, or host, store or share illegal content, including child sexual abuse material (which we report to the authorities).
- Infringe copyright, trademarks or other intellectual property rights.
- Send spam or any unsolicited messages, or send bulk or mass email of any kind, including newsletters and other opt-in mailings.
- Spread malware, run phishing or scam sites, or host botnet command-and-control servers.
- Attack, scan or probe other systems without permission, including denial-of-service attacks, brute-force logins and exploit attempts.
- Mine cryptocurrency, or run other workloads meant to keep processors at full load for long periods.
- Run Tor exit nodes, open proxies, open relays or other services that let unknown people send traffic from your server.
- Harass, threaten or dox people, or promote violence.
- Get around suspensions, limits or security controls, or interfere with other customers' services.
If we receive an abuse complaint about your service, we may ask you to fix it within a set time. For serious or ongoing harm we may suspend the service at once, without notice. Repeated or serious breaches can lead to termination.
10. Suspension and termination
We may suspend or terminate a service, or your account, if you break these Terms, if payment is overdue, if the law requires it, or to protect our platform or other people.
Where it's reasonable and safe, we will tell you first and give you a chance to fix the problem. You can close your account at any time by cancelling your services and contacting support.
11. Warranties and liability
Our services are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties not written in these Terms, including fitness for a particular purpose.
To the fullest extent the law allows, we are not liable for indirect or consequential losses, such as lost profits, revenue or data. Our total liability for any claim is limited to the amount you paid us for the affected service in the 3 months before the claim arose. Nothing in these Terms limits liability that can't be limited by law.
You agree to cover our reasonable costs from claims by others caused by your content or by your breach of these Terms.
12. Governing law
These Terms are governed by the laws of the State of New Jersey, USA, without regard to its conflict-of-law rules. Any dispute will be heard in the state or federal courts located in New Jersey, unless the law where you live gives you the right to bring it elsewhere.
13. Changes to these Terms
We may update these Terms. The date at the top shows the latest version. For important changes we will tell you in your client area or by email at least 30 days before they apply. If you don't agree, you can cancel before then and receive your unused time back. Each order records the version of the Terms it was placed under.
